The Schengen Information System or SIS is a database accessible to all Schengen countries, which stores information on all persons who have been deported from these countries for various reasons.
Important: If your data has been entered into the SIS system and you do not cancel this entry after that, then when you try to enter the territory of one of the Schengen countries you will be detained for up to 45 days, after which you may be convicted as a criminal offender who violated an administrative order prohibiting entry into the territory of this country.
Many people mistakenly think that if you change your passport, last name, first name, place of residence, you can cross the border again and everything will be fine, but when you were detained, your fingerprints were taken and your photo was taken, and these biometric data are stored in the new passport and at the border in the Schengen zone, they are also in the database, and if you violate and change the data, you will increase the period of ban on entry into the Schengen countries from 5 to 10 years!!!
So, what is the SIS system and how to delete your data from it, read below:
Common reasons for deportation and the duration of the travel ban:
- Exceeded the number of hours or days of stay in the Schengen zone based on biometrics or a visa – from 6 to 12 months ban;
- We were denied a visa and traveled using a biometric passport – from 1 to 3 years;
- Inappropriate use of the visa (for example, working in the Czech Republic or in another country on a Polish work visa) – from 1 to 3 years;
- The first entry rule was violated, that is, they entered through Poland and left (returned) through Slovakia, Hungary or other countries to Ukraine - from 1 to 3 years.
When denied entry into the country, a foreigner is stamped in their passport with a special mark (Latin letter) indicating the reasons for not being allowed across the border:
Symbols that are not deportation:
A – missing documents required for entry into the country (this concerns such basic ones as, for example, a passport)
C – there are no grounds allowing entry. That is, there is no, for example, the right to visa-free stay, visa, residence permit.
E – there is no documentary confirmation of the grounds for entry. The most common case is that there is a passport, there is a work visa, but
there is no initiation/release confirming the fact of work.
G – the amount of money required for entry has not been confirmed.
F- the days of stay in the Schengen zone have expired
Symbols indicating the presence of a ban:
And – the foreigner was recognized as a threat to society, the country, national interests, etc. Get rid of this status
quite difficult.
H – the foreigner is on the SIS lists, i.e. in the Schengen Information System (SIS) – a database of foreigners,
who are prohibited from entering the Schengen area.
D – visa or other reason for entry is false. The complexity of the case is that it is determined by the Border Guard on the spot,
and a decision on the ban can be made immediately.
B – there are other falsified documents.
Offenses and fines
In addition, the reason for entering your data into the SIS system may be a simple violation of pedestrian rules if you received a ticket for paying a fine and did not pay it.
In general, any unlawful action that harms society, as well as other actions that pose a threat to public order, internal security, or public health, is considered an offense.
Immediately after a border violation is detected, data on the violator ("information requests for the purpose of non-admission") is entered into the unified Schengen Information System (SIS database), which is accessible to all embassy and migration authorities of the Schengen area member states.
Visa quarantine in most cases lasts from 3 months to 3-5 years. Depending on the severity of the violation, visa quarantine may be accompanied by appropriate fines issued to violators directly at the border, as well as measures to forcibly deport the violator from the country.
But what if you don't have time to get to the border before your visa expires or the 90 days allowed, what should you do?
In this case, you must definitely contact the relevant authority with a request to issue written confirmation that you really cannot leave the Schengen area on time due to certain circumstances.
If you get sick, go to the hospital. If you want to cancel your flight, go to the airline office or the customs control service at the airport. If your car breaks down, go to the service center.
It is desirable that the certificates look convincing, indicating contacts, as well as the names of persons who could confirm the fact of force majeure or the event.
