Is it possible to get a divorce without the consent of your husband?

Family law

Deciding to divorce is a very serious and often emotionally difficult step, especially if the decision is made unilaterally and without the consent of the other spouse. The topic of divorce without consent in society is still shrouded in misinformation and a large number of questions. In this article, we will consider possible ways to terminate a marriage in situations where the husband does not consent to the divorce.

A marriage can be dissolved either by mutual consent of the spouses or at the request of one of the spouses. The form of such a divorce and which authority to apply to depends on whether the spouses agree to the divorce.

How to get a divorce without your husband's consent through the registry office

There is no doubt that divorce through the civil registry office is the easiest and fastest way to get divorced.

However, divorce through the Civil Registry Office is possible only under 2 conditions: the spouses have no common minor children and there is mutual consent of both spouses.

If the husband does not consent to the divorce, the woman cannot independently apply to the Civil Registry Office with an application for divorce. Such an application must be made jointly by the spouses and only on the basis of a joint application of the spouses, with the exception of certain cases, the Civil Registry Office will be able to officially register the fact of divorce.

How to get a divorce without your husband's consent through court

Since it is impossible to divorce through the Civil Registry Office without the consent of the husband, the only option for dissolving a marriage without the consent of the other spouse is to file a lawsuit with the court.

Divorce through court proceedings takes longer and also requires a bit more effort, so the best solution in this case would be to contact a lawyer who will help you properly file a claim, pay the court fee, and support you at every stage of the legal process.

Divorce through court proceedings has the following stages:

  • Collection of necessary documents;
  • Payment of court fees;
  • Filing a claim in the court at the place of registration of the husband;
  • Opening of proceedings in the case;
  • The court sends a copy of the divorce petition with documents to the husband as the other party to the case;
  • The man has the opportunity to express his position and file a response to the statement of claim;
  • Conducting court hearings;
  • The court may, if necessary, grant a period for reconciliation if there are appropriate grounds for this;
  • If reconciliation between the spouses is impossible and the divorce decision is final, the court shall issue a decree of dissolution of the marriage;
  • The court decision becomes legally effective within one month;
  • After entering into legal force, the decision is sent to the Civil Registry Office;
  • The Civil Registry Office registers the fact of divorce based on a court decision.

How to get a divorce without your husband's consent if there are children in the marriage

If there are minor children in the marriage, then the dissolution of such a marriage is possible only through a court order. At the same time, the presence of children is not a reason for refusing a divorce.

The procedure for divorce without the consent of the husband with children is the same as for spouses without children. The case may differ if there is a dispute about who the minor child will continue to live with, or if there are questions about child support and alimony.

When divorce without consent is impossible

Until November 2024, divorce was expressly prohibited by law during the wife's pregnancy and within one year after the birth of a child in the marriage.

However, after amendments to the legislation, in 2025 the law does not provide for any circumstances under which divorce between spouses is impossible. That is why divorce is possible in all cases, if it actually corresponds to the internal will of at least one of the spouses.

What documents are needed?

To get a divorce, you don't need to collect a lot of documents. This also applies to the case when there is no consent from the husband to the dissolution of the marriage. If the termination of the marriage occurs in court, the following documents are required:

  • Passports and identification codes of both spouses;
  • An extract from the place of residence of both spouses;
  • Marriage certificate;
  • Birth certificate of children (if available);
  • Receipt for payment of court fee;
  • Copies of the claim and attached documents for the husband.
