Military law and mobilizationWe were approached by a single father, a military serviceman who had been divorced from his children's mother for over 3 years and was raising one of his two children on his own. After the start of the full-scale invasion, the serviceman independently decided to mobilize into the ranks of the Armed Forces of Ukraine.
However, in the future, in order for the father to be able to properly fulfill his parental responsibilities, he needed to be released from military service, because his wife did not participate at all in the upbringing and maintenance of their common minor child.
The serviceman turned to INFERNO DIGITAL military lawyers for legal assistance for this purpose. At the initial consultation, the specialist analyzed the life situation of the serviceman and the available documents. The main problem was that the client did not have any documents confirming that he was legally raising his minor daughter alone. After all, the child's mother is alive and was not deprived of parental rights. Therefore, in order to be released from military service on this basis, the client needs a court decision on the independent upbringing and maintenance of his daughter.
Through the joint efforts of INFERNO DIGITAL lawyers and taking into account the client's position, a decision was made to file a lawsuit with the court to determine the child's place of residence together with the father in connection with the fact of his independent upbringing and maintenance of a minor child.

The following supporting documents were attached: the child's birth certificate, the court decision on divorce, and the court decision on determining the child's place of residence together with the father.
